THE FOLLOWING PROMOTION IS OFFERED ONLY TO INDIVIDUALS WHO ARE AT THE TIME OF ENTRY LEGAL RESIDENTS OF AND PHYSICALLY LOCATED IN THE CONTINENTAL UNITED STATES (EXCLUDING RHODE ISLAND) AND THE DISTRICT OF COLUMBIA (THE “TERRITORY”), 21 YEARS OF AGE OR OLDER, AND WHO POSSESS AN ACTIVE INTERNET ACCOUNT. VOID IN ALASKA, HAWAII, RHODE ISLAND, PUERTO RICO AND ALL OTHER TERRITORIES AND POSSESSIONS OF THE U.S. AND WHERE OTHERWISE PROHIBITED OR RESTRICTED BY LAW.
ELIGIBILITY:
NO PURCHASE NECESSARY. The World Golf Hall of Fame’s “Ultimate Golf Getaway” Sweepstakes (“Sweepstakes”) is open to individuals who at the time of entry are legal residents of, and physically located in, the Territory, 21 years of age or older, and who possessed an active internet account prior to January 1, 2008. Sweepstakes is void in Alaska, Hawaii, Rhode Island, Puerto Rico and other territories and possessions of the U.S. and where otherwise prohibited or restricted by law. Employees of World Golf Foundation, Inc. (“Sponsor”), John Q. Hammons Hotels Two, L.P., Resort Golf Group, LLC, Bluegreen Vacations Unlimited, Inc., CS Ventures, LLC, (“Sweepstakes Entities”), and employees of any of Sponsor or Sweepstakes Entities’ advertising and promotion agencies involved in the creation, administration or operation of the Sweepstakes, and any such employee’s immediate family members (spouse, parent, child, sibling and their respective spouses), dependents (as defined by IRS regulations), and members of their households, whether or not related, are not eligible to participate in this Sweepstakes or win a prize.
HOW TO ENTER:
The Sweepstakes begins at 12:01 a.m. Eastern Time (“ET”), January 1, 2008, and ends at 11:59 p.m. ET, May 31, 2008 (the “Sweepstakes Period”). To participate in the Sweepstakes, navigate the web to www.wgv.com, complete the electronic entry form, and submit it in accordance with the on-screen directions within the Sweepstakes Period. All entries must be received by the end of the Sweepstakes Period to be eligible for the Grand Prize Drawing. Any mass entries or entries generated by a script, macro or automated devices will be disqualified. Incomplete entries will be voided. All entries become the property of Sponsor and will not be returned. Limit: One online entry per person/per week. To view the Official Rules, visit www.wgv.com. You will only be contacted if you are selected as a potential winner of the prize offered in this Sweepstakes. Your chances of winning without making a payment or purchase are the same as the chances of someone who purchases something. It is illegal to give any advantage to buyers in a sweepstakes promotion.
DRAWING AND NOTIFICATION: The potential Grand Prize Winner will be selected from among all eligible entries received for the entire Sweepstakes Period in a random drawing conducted by an independent judging agency (“the Judges”) on or about June 5, 2008. Decisions of the Judges are final and legally binding in all respects. You do not need to be present at the drawing to win the prize. Odds of winning the prize depend on the number of eligible entries received during the Sweepstakes Period. The potential winner will be notified by phone, e-mail, and/or U.S. mail at the phone number, email address and/or address provided on the electronic entry form within 10 days of the Grand Prize drawing. In case of dispute as to identity of a potential winner, such entry will be declared made by the registered user of the e-mail account, and if a prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user. The “registered user” is the natural person to whom an e-mail address is assigned by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If a potential winner cannot be reached within seven (7) calendar days from the first notification attempt, has provided an incorrect phone number, email address or mailing address, is determined to be ineligible, fails to claim the prize within seven (7) days following the first date of attempted notification, or if a prize notification or prize is returned as undeliverable, an alternate winner will be selected without further notice. If the alternate winner fails to claim the prize within seven (7) days of the date of attempted notification, the prize will be forfeited and no additional drawings will be conducted. All unclaimed, forfeited or undeliverable prizes will not be awarded. In any case, any prize not claimed by July 15, 2008, will be forfeited. The potential winner shall be required to sign and return an Affidavit of Eligibility, a Liability Release, and where legally permissible, a Publicity Release, within seven (7) days of receipt. Winner’s travel companion (and if the travel companion is a minor, such travel companion’s parent or legal guardian) shall be required to sign and return an Affidavit of Eligibility, a Liability Release, and where legally permissible, a Publicity Release. Failure to comply with these deadlines may result in forfeiture of the prize and selection of an alternate winner. Potential winners are subject to verification before prizes are awarded. You have not yet won until your prize claim is verified in accordance with these Official Rules. By participating, the entrant agrees to abide by and be bound by these Official Rules. Sponsor reserves the right, in its sole discretion, to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules.
PRIZES/CONSUMER DISCLOSURES:
No purchase or payment of any kind is necessary to enter or win this Sweepstakes and the winners have not yet been determined. All entries must be received by the end of the Sweepstakes Period in order to be eligible to win the prize. Approximate Retail Value (“ARV”) of the prize is $2,050.00. The prize is as follows:
One (1) Grand Prize: One (1) winner will be awarded the following:
ARV: $2,050.00. The prize value may vary based on hotel availability. The odds of winning depend on the number of valid, eligible entries received during the Sweepstakes Period. The Grand Prize must be redeemed and all travel associated with redeeming the Grand Prize must be completed by the end of December 2008, or the prize will be forfeited. Blackout dates apply and reservations will be subject to space availability. No substitution or transfer of prize or cash equivalent is permitted except by Sponsor. Once the accommodations at the hotel have been arranged, they cannot be altered except by Sponsor and failure of the winner to follow such schedule shall not obligate the Sponsor in any way to provide the winner with alternate arrangements. Winner and their guest must have valid identification. The winner's travel guests must be 18 years of age or older, or if any such guest is a minor, the winner must be such minor's parent or legal guardian. ALL EXPENSES AND COSTS ASSOCIATED WITH ACCEPTANCE AND USE OF THE PRIZES NOT SET FORTH IN THESE RULES ARE THE OBLIGATION OF THE WINNER. Winner and their guest will be solely responsible for all other expenses not specifically set forth herein, including but not limited to, air or ground travel expenses, taxes, souvenirs, personal expenses, transfers, telephone fees, gratuities, personal food purchases, and travel insurance. Any portion of an awarded prize that remains unclaimed or expires will become void. All federal, state and local taxes are the sole responsibility of winners.
GENERAL RULES & CONDITIONS:
This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. By participating in the Sweepstakes, entrants agree to comply with and be bound by the terms of these Official Rules and by the decisions of the Sponsor and the Judges, which are final and binding on all matters pertaining to this Sweepstakes. The prize is awarded “as is” with no warranty or guarantee, either express or implied, outside of manufacturer’s limited warranty, if any. All Internet access and use charges are the responsibility of the entrant. Sponsor is not responsible for: lost, late, misdirected, illegible, incomplete, stolen, or inaccurate entries or for any computer, online, telephone or technical malfunctions that may occur, including, without limitation, failure of any email or entry to be received or sent by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or by human error or intervention which may occur, or any combination thereof; or any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in the Sweepstakes or from downloading any materials in the Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant or any other individual to the fullest extent permitted by law. In the event any portion of this Sweepstakes is compromised by virus, bugs, non-authorized human intervention, fraud, technical failure or other causes beyond the control of the Sponsor which, in Sponsor’s sole discretion and opinion, corrupts, or impairs the administration, security, fairness, integrity or proper play of the Sweepstakes, Sponsor reserves the right in its sole discretion, to cancel, modify, suspend or terminate the Sweepstakes in whole or in part. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the prize. Sponsor will not be responsible to award prizes in excess of the number (or value amounts) of the prize listed in these Official Rules. If by reason of printing or other error, more prizes are claimed than the one prize set forth in these Official Rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised one prize. Entrant waives the right to assert as a cost of winning a prize, any and all costs of redemption or travel to redeem said prize.
By participating in this Sweepstakes and accepting the prize, the winner agrees to the fullest extent permitted by law to indemnify and hold harmless, Sponsor, the Sweepstakes Entities, and their advertising and promotion agencies, respective parent companies, subsidiaries, affiliates, and each of their respective officers, directors, employees, agents, partners, representatives, successors, and assigns (the “Released Parties”), from and against any claims or liability incurred by or asserted against, any of the Released Parties arising out of injury incurred or caused, or claimed to have been incurred or caused, by winner or winner’s guest as a result of winner’s or winner’s guest’s participation in this Sweepstakes or any Sweepstakes related activity, or the acceptance, possession, use or misuse of any prize, including any related travel. Each entrant agrees that, to the fullest extent permitted by law, any and all disputes, claims and causes of action arising in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually and without resort to any form of class action, and exclusively by state and federal courts situated in Duval County, Florida. To the fullest extent permitted by law, the Released Parties’ liability, if any, shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, and the Released Parties shall not be liable for any punitive, incidental, special, consequential or other damages, including without limitation, lost profits, even if they are notified of the possibility thereof. Florida law, without application of Florida choice of law rules, governs the Sweepstakes and all aspects related thereto.
PUBLICITY AND PRIVACY:
Acceptance of the prize constitutes permission for Sponsor (and those permitted by Sponsor) to use and publish the winner’s name and/or likeness, biographical material, address (city and state) and/or entry (including an altered form of the entry), for advertising and promotional purposes without additional compensation, and to disclose the winner’s name, all unless prohibited by law. Subject to the foregoing, by entering into the Promotion, each entrant also agrees to Sponsor’s use of his or her personal information as described in such Sponsor’s privacy policy set forth on Sponsor’s web site at www.wgv.com and these Official Rules. In the event of any conflict between such privacy policies and these Official Rules, these Official Rules shall control and govern.
WINNER NAMES:
The Winner’s name can be obtained by sending a self-addressed stamped envelope, by July 31, 2008, to World Golf Hall of Fame “Ultimate Golf Getaway” Sweepstakes World Golf Hall of Fame One World Golf Place, St. Augustine, Florida 32092.
